End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you and Serbek Technologies, LLC ("Licensor") for the use of SketchUp construction plugins ("Software") distributed through sketchup-ai.com.

1. License Grant

This is a license, not a sale. Serbek Technologies grants you a limited, non-exclusive, non-transferable license to use the Software subject to the terms of your purchase:

• Permanent License: A one-time purchase granting perpetual use of the Software version purchased. Includes one (1) year of updates from the date of purchase. After the update period expires, the Software continues to function but will not receive new versions.
• Annual Subscription: A recurring annual license granting access to the Software and all updates for the duration of the active subscription. If the subscription lapses, access to downloads ceases, but previously downloaded versions remain installed.

2. Activation Limit

Each license may be activated on up to three (3) machines simultaneously. You may deactivate a machine to free an activation slot.

3. Restrictions

You may not:

• Redistribute, sublicense, sell, or transfer the Software
• Reverse engineer, decompile, or disassemble the Software
• Remove or alter any proprietary notices
• Use the Software for any unlawful purpose

4. Construction Disclaimer

IMPORTANT: The Software is a design aid and visualization tool only. It is NOT a substitute for professional engineering, architectural, or structural analysis. All construction projects must comply with applicable building codes and be reviewed by licensed professionals. Serbek Technologies makes no representations regarding the structural adequacy of any design created with the Software.

5. No Warranty

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. SERBEK TECHNOLOGIES DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

6. Limitation of Liability

IN NO EVENT SHALL SERBEK TECHNOLOGIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SOFTWARE. SERBEK TECHNOLOGIES' TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE.

7. Termination

This license terminates automatically if you breach any of its terms. Serbek Technologies may also terminate your license for cause. Upon termination, you must cease all use of the Software and destroy all copies.

8. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.
